Fazit

Zusammenfassend zeigt sich, dass fur Politiker und Parteien in den USA auch im Kontext der umfassenden Partizipationsmo¨glichkeiten noch einige Gelegenheiten bestehen, sich machtpolitische Vorteile zu verschaffen. Regeln ko¨nnen einerseits zum eigenen Vorteil geandert werden, wenn man in einem Einzelstaat die Gesetzgebung dominiert, so z. B. beim Zugang zu Wahlen, den beachtlichen Mo¨glichkeiten des gerrymandering oder dem front-loading.

Die zweite Route verlauft uber die Gerichte. Da hierbei keine Mehrheiten organisiert werden mussen und selbst A¨ nderungen der Verfassung uber den Umweg

der Verfassungsinterpretation und damit unter Umgehung der hohen verfassungs-

andernden Hurden mo¨glich sind, ist der Gang vors Gericht insbesondere dann reizvoll, wenn man politisch nicht uber ausreichend Macht verfugt. Nach einer Niederlage bei einer Wahlkreisneueinteilung oder direktdemokratischen Abstimmung werden Gerichte besonders haufig aktiviert und die Regularien der Wahlkampffinanzierung sind ebenfalls stark von Gerichtsurteilen gepragt. Grundlegende ¨ nderungen der demokratischen Spielregeln sind aus diesen Grunden eher von den Gerichten zu erwarten.

Drittens kommt es innerhalb des bestehenden Regelwerkes auf die Handlungen der Akteure an. So wird es interessant sein, zu beobachten, ob die Parteifuhrungen ihre zunehmenden Finanzmittel zum Ausbau ihrer innerparteilichen Machtposition

nutzen ko¨nnen und ob andererseits der Einfluss der Super PACs ansteigt. Die Kandidaten wiederum verfugen in den USA uber mehr Spielraume als ihre Pendants in Europa, wenn es darum geht, die eigene Wahlkampagne zu organisieren, Anhanger zu mobilisieren und gezielt Themen im Wahlkampf zu setzen. Diese gro¨ßeren Freiraume gehen allerdings auch mit einer starkeren Verantwortung fur den eigenen Erfolg oder Misserfolg einher.
